TERMS OF USE (BOOKINGS)

Welcome to Hawaii Family Rental (“Company,” “we,” “us,” “our”). By using hawaiifamilyrental.com (the “Site”) and/or making a reservation, you agree to these Terms of Use (“Terms”). If you do not agree, please do not use the Site or book a stay.

Eligibility
• The primary renter must be at least 21 years old.
• You confirm the information you provide is accurate and you have authority to enter into this agreement. -
Booking & Payment
• Bookings are subject to availability and are confirmed only upon successful payment.
• All payments are processed securely by Stripe. We do not store, process, or have access to full credit card numbers on our servers.
• You authorize Stripe to charge the total shown at checkout (including taxes, fees, and any applicable security holds).
• A reservation is not confirmed until you receive a written confirmation email. -
Cancellation & Refunds
• Full refund if you cancel 30 or more days before check-in (by 11:59 PM local property time).
• No refund if you cancel within 30 days of check-in.
• Any eligible refund will be returned to the original payment method via Stripe.
• All times are based on the property’s local time zone. -
House Rules
• Check-in: after 4:00 PM
• Check-out: before 11:00 AM
• Minimum age to rent: 21
• Children: allowed (ages 0–17)
• Events: not allowed
• Pets: not allowed
• Smoking: not permitted indoors
• Damage & incidentals: If you incur incidental fees or cause damage to the rental property, your credit card may be charged up to $500 to cover related costs (repairs, extra cleaning, replacements, or rule violations). -
Security Holds; Additional Charges
• We may require a refundable security hold via Stripe.
• You are responsible for any damage, excessive cleaning, missing items, or rule violations. Additional charges may be assessed accordingly. -
Guest Responsibilities
• Respect the property, neighbors, and local laws/ordinances (including noise and occupancy rules).
• Use appliances and amenities safely and as intended.
• Promptly report maintenance or safety issues.
• Only registered guests may stay overnight. -
Property Condition & Access
• You agree to leave the property in substantially the same condition as at check-in, aside from normal use.
• Management may enter the property as permitted by law (e.g., emergencies, necessary repairs, or if rules are being violated). -
Assumption of Risk; Limitation of Liability
• Travel and lodging involve inherent risks. To the maximum extent permitted by law, we are not liable for personal injury, theft, loss, or damage to personal property during your stay.
• Our total liability related to your booking or use of the Site is limited to the amount you paid for the applicable reservation. -
Force Majeure
• We are not responsible for failure or delay due to events beyond our reasonable control (e.g., natural disasters, utility outages, government actions). If a listed property becomes unavailable due to such events, we may offer a comparable alternative or a refund per the cancellation terms above. -
Prohibited Uses
• No unlawful, unsafe, or disruptive activities.
• Do not use the Site to interfere with security, infringe on others’ rights, or misrepresent identity. -
Intellectual Property
• The Site and its content (text, images, logos) are owned by or licensed to us and protected by applicable laws. You may not copy, reuse, or redistribute content without permission. -
Privacy
• Your use of the Site is also governed by our Privacy Policy (see below). -
Changes to These Terms
• We may update these Terms from time to time. The “Last updated” date will reflect the latest version. Continued use of the Site after changes means you accept the revised Terms. -
Governing Law & Venue
• These Terms are governed by the laws of the State of Hawaii, without regard to conflicts of law principles. Courts located in Hawaii have exclusive jurisdiction. -
